What is Legitimation?

In Georgia, a child that is born to unmarried parents is not the legal child of the biological father unless he files an action in Superior or Juvenile Court to legitimate his relationship to the child.  Once the legitimation is granted, he can also ask the court for rights to custody and visitation.  The father's obligation to pay support for the minor child will also be established as part of this action. A father that has failed to establish parental rights through legitimation is not entitled to visitation privileges with the child but could still be responsible for child support through an action filed with child support enforcement, a government agency.
